The Basics of Personal Injury Law
Personal injury cases occur when an individual believes he or she has been injured due to the negligence of another. Injuries can range from relatively minor issues, such as a fall on another person’s property that caused a sprain or break, to more serious issues, such as an accident that resulted in a serious burn or traumatic brain injury. A personal injury attorney is tasked with collection of evidence, communication with the opposing party or his or her attorney and representation of the client in court. The main deciding factor in a personal injury case is whether or not the defendant is guilty of negligence. Negligence does not have to be intentional in order for the accused party to be found responsible for damages. Counsel must prove that the defendant had a duty to the plaintiff that he or she failed to fulfill and that the conditions that caused the accident were made possible by said failure.
